Essential terms and conditions for working with Creative Kin
Creative Kin Terms of Service, including Creative Kin Studio Terms and Conditions of Use of the Creative Kin studio.
1. Definitions
“The Client” means any person or organisation dealing with The Studio or any agent, representative, servant, employee, or subcontractor of such person or organisation. “The Equipment” means all fixtures and fittings and all equipment situated in or provided by The Studio. “The Studio” means the location which is Creative Kin's primary studio within the Woolwich Works venue at The Fireworks Factory, 11 No. 1 Street, Royal Arsenal, London SE18 6HD. “us” or “Creative Kin” means Creative Kin Ltd. "Studio Managers" or "Studio Directors" means Creative Kin staff or representatives on duty during the time the studio is booked by The Client. “Building” means the Woolwich Works venue and all common areas, facilities, and external areas controlled by the venue operator, in which The Studio is situated.
2. Governing Agreement
These Terms and Conditions govern all services provided by Creative Kin. In the event that a separate, written contract has been executed between Creative Kin and The Client for a specific project or service (such as a Master Services Agreement or Statement of Work), the terms of that specific contract shall prevail in the case of any conflict. Where no such specific contract exists, or on matters where the specific contract is silent, these Terms and Conditions shall apply in full.
3. Equipment
The Studio agrees to provide the equipment in good working order but makes no special guarantees as to said Equipment’s functionality or suitability for The Client’s purposes. This applies in full to all Self-Op / Uncrewed Studio Hire bookings. For crewed, full-service productions where Creative Kin personnel are operating the equipment, The Client will not be held liable for any loss or damage unless it is a direct result of the Client's own negligence or misconduct. The Client may not remove any Equipment from The Studio’s premises and all Equipment must be returned promptly at the end of the hire period and in the same condition that it was in at the start of the hire period.
4. Studio Premises
The Client shall be responsible for all or any costs or expenses incurred by Creative Kin as a result of any damage by The Client to the fabric or contents (including furniture) of The Studio premises. No alterations, decorations or additions to The Studio are permitted (unless agreed in advance with The Studio).
5. Health and Safety
The Client and their guests must comply with all health and safety instructions, policies, and procedures of both Creative Kin and the Building operator (Woolwich Works). Smoking and vaping are strictly prohibited in the Building and The Studio. Food and drink other than water are not permitted in The Studio. Prior to commencing work, Clients should familiarise themselves with the location of clearly-marked fire exits and fire extinguishers. The Studio operates an emergency procedure known as "Stay Put" in the event of a fire in an adjacent area, and the Client must adhere to the instructions of Studio Managers or Building staff at all times.
6. Terms of Use & Conduct
Use of The Studio and equipment is at The Client’s own risk. The Client hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises. The Client and their party must not cause nuisance or damage to any other part of the Building, its tenants, or the venue operator’s property or reputation. The Client agrees to leave The Studio and Building in the same condition as when they arrived. The Client is solely responsible for any legal infractions they or members of their party commit during the hire period. The Client agrees to be solely responsible for the conduct and welfare of all persons accompanying them whilst in The Studio. The Studio reserves the right to stop the session and require The Client and their party to leave immediately if dangerous, negligent practices, or conduct that violates the Building's terms of use are observed. Save in respect of anything that cannot be excluded by Statute, The Studio takes no responsibility for any loss or damages suffered by The Client, caused by, or arising from its use of The Studio or any Equipment. All equipment and valuables brought on to The Studio premises by The Client shall be at The Client’s own risk.
7. Use of Studio and Services
You may use our studio and services only for lawful purposes and in accordance with these Terms and Conditions. You may not use our studio or services in any way that violates any applicable local, national, or international law or regulation, or to transmit any unsolicited or unauthorised advertising or promotional material (spam).
8. Content Standards
The material you create or record at our studio must not be illegal, fraudulent, deceptive, infringe on any third-party's intellectual property rights, be defamatory, obscene, offensive, or promote violence or discrimination.
